SOCIEDADE ANÔNIMA DO FUTEBOL - SAF: OS REFLEXOS TRABALHISTAS ADVINDOS DO INSTITUTO DA SUCESSÃO EMPRESARIAL, CONFORME A LEI N° 14.193/21

A Revista Acadêmica Online, com prazer, introduz o estudo intitulado “SOCIEDADE ANÔNIMA DO FUTEBOL - SAF: OS REFLEXOS TRABALHISTAS ADVINDOS DO INSTITUTO DA SUCESSÃO EMPRESARIAL, CONFORME A LEI N° 14.193/21" de lavratura dos pesquisadores: Luan Maia Pinheiro, Roberto Petkovic Oliveira Costa, Felipe Prata Mendes.

O presente artigo se trata de uma análise acerca da Sociedade Anônima do Futebol (SAF) e dos reflexos trabalhistas oriundos do instituto da sucessão empresarial. A metodologia utilizada foi a de pesquisa exploratória-qualitativa, por meio do estudo da Lei nº 14.193/21 e da Consolidação das Leis Trabalhistas, objetivando determinar quais serão os agentes responsáveis pela quitação dos encargos trabalhistas provenientes da sucessão empresarial realizada entre a sociedade anônima do futebol e o clube ou pessoa jurídica original. Dessa forma, verificou-se que, em razão da decretação da Lei 14.193/21 ser recente, as decisões jurisprudenciais sobre o tema não estão alinhadas e consolidadas. Finalmente, o resultado obtido foi o de que, com base no princípio da especialidade, a lei especial deve prevalecer sobre a lei geral, sendo obrigação da pessoa jurídica original arcar com as dívidas trabalhistas do clube que se tornou SAF.

ABSTRACT

The current article realizes an analysis about the Anonymous Society of Soccer (SAF) and the results of the business succession reflected in the working relations. The methodology used was the exploratory-qualitative, by the study of the law number 14.193/21 and the Consolidation of the Working Laws, with the objective of determining wich are the agents responsible for the discharge of the work costs derived of the business succession between the anonymous society of soccer and the original club or legal entity. That said, it was verified that because the decree of the law number 14.193/21 is recent, the decisions about the subject are not consolidated and aligned. Finally, the result obtained was that, based on the speciality principle, the special law must outweigh the common law, making the original legal entity have the obligation to pay the working costs generated.
