A INFLUÊNCIA DA SENTENÇA CRIMINAL ABSOLUTÓRIA SOBRE O JUÍZO DE REPARAÇÃO (AÇÃO CIVIL EX DELITO) RELACIONADO AO PRINCÍPIO DA VERDADE REAL

A Revista Acadêmica Online, com prazer, introduz o estudo intitulado “A INFLUÊNCIA DA SENTENÇA CRIMINAL ABSOLUTÓRIA SOBRE O JUÍZO DE REPARAÇÃO (AÇÃO CIVIL EX DELITO) RELACIONADO AO PRINCÍPIO DA VERDADE REAL" de lavratura da pesquisadora: Andreza Albuquerque Amore.

 

A responsabilidade civil e a criminal são discutidas em esferas distintas, entretanto deve-se observar uma harmonia entre as esferas. É nesse momento que surge a influência da sentença absolutória penal no âmbito civil, onde, dependendo da fundamentação utilizada para tal sentença, gerará ou não a impossibilidade da propositura da ação de reparação de danos na esfera civil. Dessa forma, é possível destacar a importância do Princípio da Verdade Real atrelado às decisões penais e sua interferência no juízo de reparação (ação civil ex delicto).

Abstract: 

Civil and criminal liability are discussed in different areas, however a harmony between the areas must be observed. It is at this moment that the influence of the criminal acquittal sentence appears in the civil sphere, where, depending on the grounds used for such sentence, it will or will not generate the impossibility of filing an action for reparation of damages in the civil area. Thus, it is possible to highlight the importance of the Principle of Real Truth linked to criminal decisions and its interference in the judgment of reparation (civil action ex delicto).

	Abstract: The right to an ecologically balanced environment as a fundamental right has constitutional protection and a strict relationship with human dignity. The protection of this diffuse right aims to guarantee a healthy quality of life for present and future generations. The increase in consumption by the world population represents a threat to the preservation of the environment. In this way, the State as an intervener in the economy assumes an important role in the development of public policies aimed at conserving natural resources. The present study, through bibliographical research, has the general objective of analyzing how the increase in population consumption can impact environmental protection and boost state intervention in the development of sustainable policies. As specific objectives, the research aims to identify the environment as a fundamental right for the community, relate population growth and increased consumption, as well as address the study of economic alternatives to encourage “green policies” through the interventionist actions of the Public Power.
