A Curatela X Tomada de Decisão Apoiada em Face do Ordenamento Jurídico Pátrio: Uma Visão a Partir da Lei 13.146/2015
A Revista Acadêmica Online, com prazer, introduz o estudo intitulado “A Curatela X Tomada de Decisão Apoiada em Face do Ordenamento Jurídico Pátrio: Uma Visão a Partir da Lei 13.146/2015" de lavratura do pesquisador: Diego Augusto Silva De Carvalho.
Este artigo tem como objetivo principal analisar criticamente as mudanças trazidas pelo Estatuto da Pessoa com Deficiência em relação à Curatela e à Tomada de Decisão Apoiada, e examinar como essas mudanças se relacionam com o Código Civil de 2002. Para isso, é realizada uma revisão bibliográfica e análise da legislação vigente, destacando as principais alterações promovidas pelo Estatuto. É verificado como a Curatela e a Tomada de Decisão Apoiada são tratadas no contexto do Estatuto da Pessoa com Deficiência e como essas mudanças impactam na interpretação e aplicação do Código Civil de 2002. Conclui-se que é fundamental compreender as implicações do Estatuto da Pessoa com Deficiência na relação entre a Curatela e a Tomada de Decisão Apoiada, bem como sua relação com o Código Civil de 2002, visando uma adequada proteção dos direitos das pessoas com deficiência.

ABSTRACT: This article aims to critically analyze the changes brought about by the Statute of Persons with Disabilities regarding Guardianship and Supported Decision-Making, and examine how these changes relate to the Civil Code of 2002. For this purpose, a bibliographic review and analysis of current legislation are conducted, highlighting the main alterations promoted by the Statute. It is verified how Guardianship and Supported Decision-Making are addressed in the context of the Statute of Persons with Disabilities and how these changes impact the interpretation and application of the Civil Code of 2002. It is concluded that it is essential to understand the implications of the Statute of Persons with Disabilities on the relationship between Guardianship and Supported Decision-Making, as well as its relationship with the Civil Code of 2002, aiming at adequate protection of the rights of persons with disabilities.
